1. Scope and Provider
These Terms and Conditions ("Terms") govern participation in the Early Access program and the use of the "Elevate" browser extension (the "Service") provided by

The Service is offered exclusively to entrepreneurs and business customers who use LinkedIn professionally. It is not offered to consumers.
2. Description of the Service
Elevate is a browser extension (Chrome extension) that uses artificial intelligence to create drafts for LinkedIn comments, posts, and direct messages, based on the information the user provides (e.g. offer, target audience, style). Elevate does not publish any content automatically; every publication requires an active action by the user.
3. Early Access Program
- Access to the Service is currently only available through a closed Early Access program.
- Participation requires an application via the form on the website. There is no entitlement to participate; the Provider selects participants at its own discretion.
- Participation in the Early Access program is subject to a fee. Prices and payment terms are communicated to the user before the contract is concluded and agreed separately. Payments are processed via the payment provider Stripe. There is no automatic conversion into any other paid offering.
- The Service is under development. Its features, availability, and conditions may change at any time during the Early Access phase; the Service may be discontinued in whole or in part.
- Participation renews automatically for the respective billing period. The user may cancel at any time, directly via Stripe or by notifying the Provider; the cancellation must be submitted at least one week before the renewal date, otherwise it takes effect only at the end of the following billing period.
- The Provider may end participation with one week's notice to the end of the current billing period. If the Provider discontinues the Service, fees already paid for periods after discontinuation will be refunded pro rata.
4. User Obligations
- The user provides truthful information in the application.
- The user is solely responsible for complying with the LinkedIn terms of service applicable to them. Elevate is not affiliated with LinkedIn.
- The user reviews all drafts generated by the Service before publishing and decides at their own responsibility whether and in what form to use them.
- The user does not use the Service to create or distribute unlawful, misleading, or third-party rights-infringing content.
- Access credentials and Early Access program access must be kept confidential and may not be shared with third parties.
5. AI-Generated Content
Texts generated by the Service are created automatically using AI models. They may be inaccurate, incomplete, or unsuitable for the given context. The Provider gives no warranty as to the correctness, appropriateness, or legality of the drafts. The user is solely responsible for any published content.
6. No Influence on LinkedIn Accounts
The Provider has no influence on decisions made by LinkedIn, in particular rate limits, account restrictions, or suspensions. How much content the user publishes, at what pace, and with what behavior is solely the user's responsibility. Section 9 (Liability) remains unaffected.
7. Rights of Use
For the duration of the Early Access phase, the user receives a simple, non-transferable, non-sublicensable right to use the Service for their own business purposes. Decompiling, reverse engineering, or circumventing technical protection measures is prohibited, subject to mandatory statutory rights. The Provider claims no rights to the texts created with the Service and published by the user.
8. Availability
The Provider strives for good availability of the Service but does not owe any specific availability, absence of errors, or support of any particular scope during the Early Access phase.
9. Liability
The Provider is liable only for damages caused by intent or gross negligence. To the extent permitted by law, any further liability – in particular for slight negligence and for auxiliary persons – is excluded. To the extent permitted by law, liability is excluded in particular for indirect and consequential damages, lost profits, loss of data, and damages resulting from restrictions or suspensions of the user's LinkedIn account. Where liability cannot be excluded, it is – except in cases of intent or gross negligence – limited to the fees paid by the user for the Service in the twelve months preceding the event giving rise to the damage. Mandatory statutory liability provisions remain reserved.

11. Changes to these Terms
The Provider may amend these Terms with effect for the future to the extent reasonable for the user. Changes will be announced by email with reasonable notice. If the user does not object or continues to use the Service, the amended Terms apply; the announcement will point this out.
12. Final Provisions
- Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.
- The exclusive place of jurisdiction is Zurich, Switzerland.
- Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
- The contract language is English. The German version is for information only; this English version prevails.
